A residential property cannot be advertised for sale until a contract of sale has been prepared. The contract must contain a copy of the title documents, drainage and sewerage location diagram and a current Zoning Certificate (section 10.7) issued by the local council. If the property for sale has a swimming or spa pool, a copy of a valid certificate of compliance, a valid occupation certificate (issued in the past 3 years) and evidence that the pool has been registered, or a valid certificate of non-compliance must also be annexed. If you fail to attach one of these documents to the sales contract, the purchaser may be entitled to rescind the sales contract within 14 days of exchange.

There are two main ways of selling a residential property:
by Private Treaty or by Auction.

Next step is exchange of contracts, wherein two copies of the sale contract are exchanged or “swapped”. Following exchange the buyer and seller are legally bound by the contract. We will manage the Post Exchange phase and the lead up to settlement whilst always liaising with you every step of the way!

We will meet with you and complete our Verification of Identity requirements and additional paperwork as required by PEXA and under the regulations. Most importantly we will complete a Vendor Questionnaire to ensure we know all there is to know about your property.

Our team will begin ordering of the disclosure documents and preparation of the Contract for Sale.

Once completed we will issue a copy of the Contract for Sale to your chosen marketing agent and to you for your review and approval of same.

During this period of open homes (or in lead up to an auction) we field questions and seek instructions from you on any requested amendments to the contract.

Will take place following offer and acceptance or at auction.

We will begin the discharge process with your mortgagee, reply to requisitions on title, open a PEXA workspace and manage its contents including inviting your discharging mortgagee, finalise any additional searches required.

Check and Prepare settlement figures for your review and approval together with letters pre settlement, obtain a payout figure from the discharging mortgagee, input figures into PEXA, confirm your bank account details for fund transfer and account to you.

Finalise your matter by sending final settlement statement and post settlement letter.
